You are driving a vehicle in a built-up area. Does the visible prohibition sign apply to passenger cars?
Show the correct answer
Correct answer
YES
Explanation
In the video you are driving on a roadway of a dual carriageway in a city, along noise barriers; on both sides of the roadway there are signs B-33 "speed limit" of 70 km/h. You are driving in a built-up area, and the visible prohibition sign applies to passenger cars. The answer is: yes.
The Regulation on road signs and signals states that sign B-33 means a ban on exceeding the speed shown on the sign, and sign B-33 showing a permitted speed higher than 50 km/h, placed in a built-up area, applies to a passenger car, a motorcycle and a lorry with a maximum permissible mass of up to 3.5 t. Such a sign does not lower the limit but raises it: instead of the statutory 50 km/h you may drive at 70 km/h - but only in the vehicles listed in the rule: passenger cars, motorcycles and lorries up to 3.5 t. A bus, a lorry over 3.5 t or a vehicle combination still drives at 50 km/h, because for them the sign does not apply. There are also exceptions, for example for a car towing another vehicle, a car carrying dangerous goods or a motorcycle carrying a child up to 7 years of age. So in a passenger car you may drive at 70 km/h, but you do not have to - if conditions are bad, you drive more slowly.
Legal basis: § 27 para. 1 and 3 of the Regulation on road signs and signals; Art. 20 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
