Question no. 9379 3 pts basic B

In the presented situation, does the stop prohibition apply also to the pavement?

Show the correct answer

Correct answer

YES

Explanation

In the video you are driving along a street in a town along a fence and trees; on the right there is sign B-36 "no stopping", and a car is coming from the opposite direction. The visible no-stopping ban also applies to the pavement. The answer is: yes.

The Regulation on road signs and signals states that sign B-36 means a ban on stopping a vehicle, and this ban applies to the side of the road on which the sign stands - the road, not only the roadway, so it also covers the shoulder and the pavement on the right-hand side. The Road Traffic Act confirms this: stopping a car on a footway (droga dla pieszych), that is on the pavement, with the wheels of one side or the front axle is allowed only when there is no ban on stopping or parking on that section of the roadway. Since B-36 applies, this condition is not met and driving onto the pavement changes nothing. The ban applies from the place where the sign stands up to the nearest junction or until it is cancelled, and the only exception is a standstill forced by traffic - for example stopping in a traffic jam or for a pedestrian on a crossing.

Legal basis: § 28 para. 2, para. 3 point 1 and 3 and para. 4 and § 32 para. 2 of the Regulation on road signs and signals; Art. 47 para. 1 point 1 of the Road Traffic Act (Prawo o ruchu drogowym)
