Terms of Service of the Łatweprawko website and app
Version of 08.10.2026 · version 1This is a translation provided for convenience. In case of any discrepancy, the Polish version prevails.
§ 1. General provisions
- These terms set out the rules for using the website available at latweprawko.pl (the "Service") and the Łatweprawko mobile app for iOS and Android (the "App"), as well as the rules for selling paid Packages giving access to digital content. The Service and the App are together referred to as the "Platform".
- The service provider and seller is PRESSWAY Bartłomiej Paluch, Zarzecze 268, 38-220 Dębowiec, tax identification number (NIP) 6852340178, an entrepreneur entered in the Central Register and Information on Economic Activity of the Republic of Poland (Centralna Ewidencja i Informacja o Działalności Gospodarczej, CEIDG) kept by the Minister of Development and Technology (the minister responsible for the economy) (the "Service Provider"). Contact: e-mail kontakt@latweprawko.pl, the form on the Contact page and the telephone number given on the Contact page. The same e-mail address is used for complaints, withdrawal from the contract and reports.
- These terms are the terms and conditions for the provision of services by electronic means within the meaning of Art. 8 of the Act of 18 July 2002 on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną). They are made available free of charge in the Service and in the App before you start using them (a link in the footer of the Service and in the App settings), in a way that allows you to obtain, reproduce and record them (including downloading and printing).
- Starting to use the free features of the Platform is equivalent to concluding a free-of-charge contract for the provision of services by electronic means on the terms of these terms. Creating an Account and buying a Package require your express acceptance of these terms.
- The Polish version of these terms is the binding version. Translations into other languages are provided for information only; in case of any discrepancy, the Polish text prevails.
§ 2. Definitions
- User - a natural person who uses the Platform.
- Consumer - a User who is a natural person and concludes a contract with the Service Provider that is not directly related to their business or professional activity.
- Sole Trader with Consumer Rights - a natural person who concludes a contract directly related to their business activity, where the content of that contract shows that it is not of a professional nature for that person, resulting in particular from the subject of their business activity as made available under the provisions on the Central Register and Information on Economic Activity (Art. 7aa(1) of the Consumer Rights Act (ustawa o prawach konsumenta)). Such a person may, at the latest when placing the order, declare to the Service Provider (e.g. by e-mail) whether the contract is of a professional nature for them; making such a declaration is not a condition of purchase (Art. 7aa(2)). Choosing the "company" option when placing an order is used to issue an invoice and is not such a declaration. A Sole Trader with Consumer Rights has the Consumer rights described in § 8 (the right to withdraw from the contract within 14 days, subject to the exception in § 8(3)), § 9 (conformity of Digital Content with the contract and complaints), § 12, § 13(4), § 15 and § 18; wherever these terms refer to a Consumer, this also applies to a Sole Trader with Consumer Rights.
- Account - the set of resources and settings on the Platform assigned to a User after registration, shared by the Service and the App.
- Package - paid access to the full version of the Platform for a specified number of days, counted from the activation of access.
- Digital Content - data produced and supplied in digital form within the meaning of the Consumer Rights Act: the base of exam questions with multimedia, question explanations and the catalogue of road signs. A Package also includes features that process the User's data (the course with a spaced repetition algorithm, mock exams, statistics, the estimated chance of passing), to which the provisions on digital services apply to the extent indicated in these terms. The provisions of these terms on Digital Content apply to the whole Package unless these terms provide otherwise.
- Store - the App Store operated by Apple or Google Play operated by Google, through which the App is made available and in which a Package can be bought.
- Price List - the current list of Packages with prices, available in the Service at latweprawko.pl/cennik and, for purchases in a Store, in the App.
- Durable Medium - in particular an e-mail message sent to the User's address and a file attached to such a message.
§ 3. Free and paid services
- Free of charge and without creating an Account, the Platform provides:
- a mock exam on a limited pool of questions (the demo pool) in each driving licence category, with a daily limit of exams started per demo session and an additional limit per IP address; a practice set without grading does not use up the limit;
- informational content: the knowledge base, the blog, question pages, the catalogue of road signs, category pages and the price list.
- Free of charge, after creating an Account, the Platform additionally provides: mock exams on the demo pool with a higher daily limit than without an Account, exam history and basic Account settings. Exams started on the same day without an Account and transferred to the Account on registration or login count towards the Account limit.
- The current limits referred to in paragraphs 1 and 2 are stated on the Platform: on the exam start screen, on the test pages and after the limit has been used up. Days are counted according to Polish time. The Service Provider may change the limits of the free features by stating them on the Platform; a change of limits does not apply to Packages, which have no daily exam limit.
- After buying a Package, for the duration of the Package the User gets access to the full version of the Platform: the entire question base in all categories with multimedia, the course with a spaced repetition algorithm that selects questions according to the User's progress, mock exams on the full pool, statistics and the estimated chance of passing, question explanations and road sign learning, in the languages made available on the Platform.
- The exam questions and multimedia come from the public catalogue of questions published by the minister responsible for transport. The Service Provider updates the base after new versions of the catalogue are published and states the version date in the footer of the Service. The translations of the questions into Ukrainian, English and German come from the same catalogue; the question explanations and the knowledge base content are the Service Provider's own work.
- The Platform is a learning tool. It is not the official state exam, it is not run by a provincial road traffic centre (wojewódzki ośrodek ruchu drogowego) or any other authority, and it does not guarantee that you will pass the exam. The result of a mock exam is an estimate based on the rules of the state exam.
- The Service Provider may make new features, languages or categories available and change the way they are presented, provided this does not restrict the scope of the Package described in paragraph 3 (see § 12).
§ 4. Technical requirements, interoperability and protection measures
- Service: a device with internet access, an up-to-date browser (Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled, and an active e-mail address. Videos in questions require a browser that plays video in MP4 (H.264) format.
- App: a phone running iOS or Android in a version supported by the Store at the time of download, internet access and a Store account. The App does not work offline: questions, multimedia and results are downloaded from the Service Provider's server. Multimedia may use mobile data.
- The Service Provider may specify in the App the minimum required version of the App. Until it is updated, an older version may be blocked for security reasons or for reasons of API compatibility. The update is free of charge and available in the Store. The Service Provider informs you in the App about an available update and about the consequences of not installing it.
- Using the Platform involves the typical risks present on the Internet (malware, phishing, password theft). The Service Provider applies the safeguards described in the Privacy Policy and recommends using a unique password and two-step verification.
- Technical protection measures for content: Digital Content is available only after logging in, within a single Account, in streaming form, without the possibility of downloading files to the device; access under a Package is assigned to one Account, and the App may require an update to the minimum version (paragraph 3). The Service Provider may limit the number of simultaneous sessions of one Account.
§ 5. Account and age of the User
- Registration requires providing a first name (or a nickname), an e-mail address and a password, or using Google, Apple or Facebook login, as well as accepting these terms and reading the Privacy Policy. When buying a Package, an Account can be created with just an e-mail address; the User sets a password later in the Account settings or using the password recovery feature. The e-mail address must be confirmed via a link; until it is confirmed, some Account features are unavailable.
- The contract for maintaining an Account is concluded at the moment of registration, for an indefinite period, free of charge. The User may terminate it at any time by deleting the Account in the settings (Service and App) or by writing to the Service Provider.
- A person who is at least 16 years old may create an Account on their own. For a younger person (e.g. one preparing for category AM from the age of 14), the Account is created by a parent or legal guardian, who accepts these terms on their behalf. The purchase of a Package by a person under 18 requires the consent of a parent or legal guardian; by placing the order and making the declaration referred to in § 8(3), that person confirms that they have obtained such consent. The Service Provider does not verify age, but upon receiving credible information that the required consent is missing, it deletes the Account and settles the price of the Package in accordance with the provisions of the Civil Code (Kodeks cywilny) on legal acts performed by persons with limited legal capacity.
- One Account is intended for one person. Sharing login details with other people and the use of one Account by several people are prohibited.
- The User is responsible for keeping their password confidential and for actions taken using the Account, unless those actions result from circumstances for which the User is not responsible. In the settings you can enable two-step verification, remember a trusted device for 30 days, review linked external accounts and active devices, and log out of all devices.
- Deleting an Account results in the anonymisation of the Account data and the erasure of learning data (details in the Privacy Policy). Deleting an Account while a Package is active is equivalent to terminating the Package contract; in that case the Consumer is entitled to a refund of the part of the price proportional to the unused full days of the Package, paid within 14 days of the request being sent to kontakt@latweprawko.pl. Before an Account is deleted, the Platform warns about an active Package.
§ 6. Buying a Package in the Service
- The current Packages, number of days and prices are stated in the Price List and when placing an order. Prices are gross prices in Polish zloty and include taxes, where applicable. The binding price is the price shown at the moment the order is placed. The Service Provider does not personalise prices on the basis of automated decision-making.
- If the Service Provider announces a price reduction, it states next to the reduced price the lowest price of that Package in the 30 days preceding the reduction (Art. 4(2) of the Act of 9 May 2014 on Informing about the Prices of Goods and Services (ustawa o informowaniu o cenach towarów i usług)). Discount codes and gift codes are subject to the conditions stated with the code (validity, number of uses, Package).
- An order in the Service is placed by a logged-in User by: choosing a Package, choosing whether the purchase is private or for a company (in which case they provide the name, tax identification number (NIP) and address for the invoice), entering a discount code if any, accepting these terms, making the declaration described in § 8(3) and clicking the button confirming the order with an obligation to pay. The User then pays on the payment operator's page or, when paying with a BLIK code, confirms the payment in their banking app. In the case of a purchase for a company, the party to the Package contract is the entrepreneur indicated in the invoice details, and the User declares that they are authorised to act on its behalf; the Account remains assigned to the User.
- The contract for the supply of Digital Content is concluded at the moment the operator confirms the payment. Immediately after the payment is confirmed, the Service Provider sends to the Account e-mail address a confirmation of the conclusion of the contract (Durable Medium) containing the order number, the name of the Package, the price, the date access ends, these terms as worded on the date of purchase (a file attached to the message) and information about the Consumer's request for immediate supply and the loss of the right of withdrawal. An order not paid within 24 hours of being placed expires and creates no obligations.
- Payments in the Service are handled by the ING Pay gateway, operated by ING Bank Śląski S.A. with its registered office in Katowice, ul. Sokolska 34, 40-086 Katowice, National Court Register (KRS) number 0000005459. Available methods: BLIK, payment card, fast online bank transfer, Apple Pay and Google Pay. Card details are provided only to the operator; the Service Provider neither receives nor stores them. The payer may be asked to accept the operator's terms. Using means of distance communication (internet, e-mail, telephone) does not involve charges higher than those normally applied by the User's provider.
- A Package does not renew automatically and is not a subscription. No recurring charges are made, and the Package contract does not impose on the Consumer any minimum duration of obligations other than the one-off payment of the price. Another Package bought while the previous one is still active extends access: the new days are counted from the day the current access ends. In that case the supply of the new Package begins at the moment the current access ends, and the declaration referred to in § 8(3) concerns the start of supply at that moment; until supply begins, the Consumer has the right of withdrawal on the terms of § 8(2).
- Sales are documented in the Service Provider's sales records. For a purchase for a company, an invoice is issued automatically (in the National e-Invoicing System (Krajowy System e-Faktur), if the Service Provider is obliged to use it) and sent by e-mail as a PDF; it is also available in the Account settings. A Consumer who wishes to receive an invoice must notify the Service Provider no later than 3 months from the end of the month in which the Package was paid for (Art. 106b(3) of the Value Added Tax Act (ustawa o podatku od towarów i usług)). The User agrees to receive invoices in electronic form.
§ 7. Buying a Package in the App (App Store and Google Play)
- In the App, a Package can be bought only as an in-app purchase through the Store, on the Store's terms and with funds settled by the Store. Prices in the Store may differ from prices in the Service, among other things because of Store commissions and price tiers set by the Store; the binding price is the price displayed in the Store at the time of purchase.
- The party to the purchase transaction, the issuer of the proof of purchase and the entity responsible for settling the payment is, respectively, Apple Distribution International Ltd. (Hollyhill Industrial Estate, Hollyhill, Cork, Ireland) for the App Store or Google Commerce Limited (70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland) for Google Play, in accordance with the Apple Media Services Terms and Conditions or the Google Play Terms of Service. The Service Provider has no access to the User's payment data or to their Store account.
- A purchase in the App requires logging in to an Account. After the Store confirms the transaction, the Service Provider assigns the Package to the Account on which the purchase was made. A Package bought in the Store also works in the Service after logging in to the same Account. The same purchase cannot be assigned to a second Account. The "restore purchases" feature reports the purchases from the Store account to the Service Provider again, e.g. after changing your phone.
- The right of withdrawal and refunds for a purchase in the Store are handled by the Store under its own terms. In the App Store, a Consumer may cancel an order within 14 days of receiving the receipt, unless they requested immediate supply and acknowledged the loss of that right; a refund can be made only by Apple, and the request is submitted at reportaproblem.apple.com. In Google Play, buying digital content means consenting to immediate access and losing the statutory right of withdrawal; a refund is available if the content is defective, unavailable or not as described, and it is made by Google or, at the User's request sent by e-mail, by the Service Provider using the Google Play seller tools. On request, the Service Provider helps to submit a refund request. A refund granted by the Store results in access to the Package being withdrawn.
- Complaints concerning the operation of a Package (conformity of Digital Content with the contract) are submitted by the User to the Service Provider on the terms of § 9, regardless of where the purchase was made.
§ 8. Supply of Digital Content and the right of withdrawal
- Access to a Package is activated immediately after the payment is confirmed, usually within a few minutes and no later than within 24 hours, subject to § 6(6). Digital Content is deemed supplied at the moment access is activated on the Account (Art. 43j of the Consumer Rights Act). If access is not activated, the User calls on the Service Provider to supply it, and if the call is unsuccessful, may withdraw from the contract.
- A Consumer who has concluded a distance contract may withdraw from it within 14 days of the day the contract was concluded without giving any reason (Art. 27 of the Consumer Rights Act), subject to paragraphs 3 and 3a. The same right, on the same terms and with the same exceptions, is available to a Sole Trader with Consumer Rights, that is, a natural person who buys a Package in connection with their business activity, where the contract is not of a professional nature for them (Art. 7aa of the Consumer Rights Act); this also applies to a purchase with an invoice for a company.
- In accordance with Art. 38(1)(13) of the Consumer Rights Act, the right of withdrawal does not apply to a contract for the supply of Digital Content not supplied on a tangible medium for which the Consumer is obliged to pay the price, if the Service Provider has begun performance with the express and prior consent of the Consumer, who was informed before performance began that they would lose the right of withdrawal once performance has been completed and acknowledged this, and the Service Provider has provided them with a confirmation on a Durable Medium (§ 6(4)). The Consumer makes this declaration when placing the order by ticking the box: "I ask for access to start immediately after payment. I acknowledge that for digital content I thereby lose the right to withdraw from the contract, and that for digital services included in the package I will pay for what was provided up to the moment of withdrawal if I withdraw." 3a. To the extent that a Package includes a digital service (§ 2), a Consumer who has made the declaration referred to in paragraph 3 and withdraws from the contract before the service has been fully performed pays an amount proportional to the number of days of the Package that have elapsed up to the day of withdrawal (Art. 35 of the Consumer Rights Act); the Service Provider refunds the remaining part of the price within 14 days.
- A Consumer who does not wish to make the declaration referred to in paragraph 3 may write to the Service Provider before the purchase. In that case access to the Package will be activated after 14 days from the conclusion of the contract or earlier, once the declaration is made at a later time, and until access is activated the Consumer has the right of withdrawal.
- A notice of withdrawal can be sent by e-mail to kontakt@latweprawko.pl, including by using the model form provided at the end of these terms. To meet the deadline, it is sufficient to send the notice before the deadline expires. The Service Provider confirms receipt of the notice by e-mail and refunds the payment without undue delay, no later than within 14 days, using the same method that the Consumer used, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs for them.
- § 7(4) applies to purchases in the Store.
§ 9. Conformity of Digital Content with the contract and complaints
- The Service Provider supplies Digital Content in conformity with the contract, including the description in § 3 and the requirements in § 4, and is liable to the Consumer and to the Sole Trader with Consumer Rights for any lack of conformity on the terms of Chapter 5b of the Consumer Rights Act (Art. 43h-43q). A Package is supplied continuously, so the Service Provider is liable for any lack of conformity that occurred or became apparent during the term of the Package (Art. 43l(3)). For the term of the Package, the Service Provider supplies the updates necessary to keep the Platform in conformity with the contract.
- In the event of a lack of conformity, the Consumer may demand that the Digital Content be brought into conformity with the contract (Art. 43m). The Consumer may make a declaration of price reduction or withdraw from the contract if: bringing the content into conformity is impossible or would require excessive costs; the Service Provider has not brought the Digital Content into conformity within a reasonable time and without excessive inconvenience; the lack of conformity persists despite an attempt to remedy it; the lack of conformity is so significant that it justifies a price reduction or withdrawal without first demanding a remedy; or it is clear from the Service Provider's statement or the circumstances that it will not bring the Digital Content into conformity (Art. 43n(1)). The Consumer may not withdraw from the contract if the lack of conformity is insignificant; it is presumed to be significant (Art. 43n(3)). The amount due is refunded without undue delay, no later than within 14 days of receipt of the declaration.
- Complaints are submitted by e-mail to kontakt@latweprawko.pl or via the form on the Contact page. It helps to include the Account e-mail address, a description of the problem, the date it occurred and, if possible, the device and browser or App version.
- The Service Provider responds to a complaint within 14 days of receiving it, on a Durable Medium (e-mail). Failure to respond within that period means that the complaint has been accepted (Art. 7a of the Consumer Rights Act).
- The content of questions, answers and multimedia is in conformity with the contract if it corresponds to the current version of the official catalogue, which the Service Provider does not create, even if the catalogue contains substantive errors. The Service Provider takes subsequent versions of the catalogue into account and verifies reports. An error in a question or explanation can be reported using the button next to the question or by e-mail.
- The Service Provider does not provide any guarantee beyond the liability arising from the law and does not provide after-sales services other than the assistance described in these terms. The Service Provider does not apply a code of good practice within the meaning of the Act on Counteracting Unfair Market Practices (ustawa o przeciwdziałaniu nieuczciwym praktykom rynkowym).
- In relation to a User who is neither a Consumer nor a Sole Trader with Consumer Rights, the Service Provider's liability under the statutory warranty (rękojmia) is excluded, and liability for damages is limited to the amount paid for the Package, except for damage caused intentionally.
§ 10. Out-of-court dispute resolution
- The Service Provider seeks to resolve every dispute amicably. As a first step, it is worth writing to kontakt@latweprawko.pl.
- A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular: mediation conducted by the provincial inspector of the Trade Inspection (Inspekcja Handlowa), permanent consumer arbitration courts at the provincial inspectorates of the Trade Inspection, and the free assistance of a district (municipal) consumer ombudsman (powiatowy (miejski) rzecznik konsumentów) or of consumer organisations (e.g. Federacja Konsumentów). The rules of access to these procedures are set out in the Act of 23 September 2016 on Out-of-Court Resolution of Consumer Disputes (ustawa o pozasądowym rozwiązywaniu sporów konsumenckich); information is available on the website of the Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów) (uokik.gov.pl).
- Participation in out-of-court proceedings is voluntary for both parties. The Service Provider states its position on participating in such proceedings in its response to a complaint if the complaint is not accepted.
§ 11. Licence and intellectual property
- The layout of the Platform, the software, graphics, question explanations, knowledge base and blog content, descriptions of signs, interface translations and databases are subject to the rights of the Service Provider or its licensors and are protected by copyright and by the provisions on the protection of databases. The exam questions and multimedia from the official catalogue are made available as public information and are not covered by the Service Provider's rights.
- The User receives a non-exclusive, non-transferable licence, limited to their own personal use, to use the Platform and Digital Content on the devices from which they log in, for the duration of the Account and, as regards a Package, for the duration of that Package. The licence for the App covers installing and using it on mobile devices that the User owns or controls, in accordance with the Store's rules (including Family Sharing in the App Store, if the Store allows it for the App).
- In particular, the following are prohibited: copying, reproducing and distributing explanations, knowledge base content and other materials beyond permitted personal use; automated downloading of content (scraping, bots); circumventing security measures and access restrictions; decompiling and reverse engineering the App except in the cases permitted by Art. 75 of the Act on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych); reselling or sharing access to a Package.
§ 12. Changes to Digital Content and to the Platform
- Where this is not necessary to keep it in conformity with the contract, the Service Provider may change the Digital Content supplied under a Package only for justified reasons: publication of a new version of the official question catalogue, a change in the law or in the rules of the state exam, improved security, adaptation to new versions of operating systems and browsers, the introduction of new or improved learning features that do not restrict the scope of the Package under § 3(3), and the removal of errors. The change does not involve any costs for the User, and the Service Provider informs about it on the Platform in a clear and comprehensible manner (Art. 43p of the Consumer Rights Act).
- If a change has a significant negative impact on access to or use of the Digital Content, the Service Provider informs the Consumer about it by e-mail reasonably in advance, stating the characteristics and date of the change and informing them of the right to terminate the contract described below or of the possibility of keeping the Digital Content unchanged at no additional cost. The Consumer may then terminate the contract without notice within 30 days of the change being made or of being informed about it, whichever is later (Art. 43q). In that case the Service Provider refunds the part of the price proportional to the unused period of the Package.
- The Service Provider may add new free features and change, suspend or withdraw free features, informing about this on the Platform.
§ 13. Rules of use, unlawful content and Account blocking
- The User is prohibited from providing unlawful content (Art. 8(3)(2)(b) of the Act on the Provision of Electronic Services), including in error reports, messages and the Account name, as well as from actions that disrupt the operation of the Platform, attempts at unauthorised access, deliberately circumventing the demo exam limit and breaching § 5(4) and § 11(3).
- Content entered by the User (error reports, messages) is not published on the Platform and is used only by the Service Provider to handle the report.
- In the event of a breach of these terms, the Service Provider calls on the User by e-mail to stop the breach and, if the breach continues, may block the Account. In the case of gross breaches (e.g. mass downloading of content, hacking attempts, reselling access), the Account may be blocked without a prior call. The Service Provider states the reason for the blocking, and the User may appeal against it by e-mail within 14 days; the Service Provider responds within 14 days.
- Blocking a Consumer's Account through the Consumer's fault while a Package is active is equivalent to terminating the Package contract for reasons attributable to the Consumer. The Service Provider refunds the part of the price for the unused period, but may deduct documented damage caused by the breach (e.g. the costs of counteracting mass downloading of content), up to no more than the amount being refunded. If the blocking proves unjustified, the Service Provider restores access and extends the Package by the duration of the blocking.
§ 14. Communication and notifications
- The Service Provider sends e-mails necessary to manage the Account and the contract: address confirmation, password reset, security codes, order confirmation, invoices, and information about changes to these terms and to Digital Content.
- Learning reminders (by e-mail and, in the App, by push notification) concern only the User's learning and contain no offers or advertisements. Reminders and news updates are optional and can be switched on or off in the Account settings at any time. Push notifications additionally require consent given in the phone's operating system. Commercial information is sent only with the User's consent (Art. 398 of the Act of 12 July 2024 - Electronic Communications Law (Prawo komunikacji elektronicznej)).
§ 15. Availability of the Platform and liability
- The Service Provider makes every effort to ensure that the Platform operates without interruption. Planned technical breaks are carried out, where possible, between 23:00 and 6:00; the Service Provider announces a break longer than 2 hours on the Platform at least 24 hours in advance. If the Platform is unavailable for reasons attributable to the Service Provider for a total of more than 6 hours in a month, the Service Provider extends the Package by the total period of unavailability. This does not exclude the Consumer's rights under § 9.
- The Service Provider is not liable for lack of access resulting from causes attributable to the User or their internet provider, from the use of a device or system that does not meet the requirements of § 4, from failure to install, within a reasonable time, an App update provided by the Service Provider of which, and of the consequences of not installing which, the User was informed (Art. 43k(4) of the Consumer Rights Act), or for the consequences of sharing login details with third parties.
- The provisions of these terms do not exclude or limit the Consumer's rights under mandatory provisions of law. In the event of a conflict, those provisions prevail.
§ 16. Additional provisions for the App
- The licence agreement for the App is concluded solely between the User and the Service Provider, not with Apple or Google. Apple and Google are not parties to this agreement, are not responsible for the App or its content and have no obligation to provide any technical support for the App. The Service Provider alone is responsible for the maintenance, support and updates of the App; help is available at kontakt@latweprawko.pl and via the contact details in § 1(2).
- For an App downloaded from the App Store: if the App fails to conform to any applicable warranty or conformity requirements, the User may notify Apple, and Apple will refund the purchase price of the App (if one was paid); to the extent otherwise, Apple has no warranty obligations whatsoever. The Service Provider is responsible for handling any claims relating to the App, including product liability claims, claims of non-compliance with the law and consumer protection or privacy claims, and for defending against third-party claims of intellectual property infringement. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, once the User accepts these terms, have the right to enforce them against the User.
- The User declares that they are not located in a country subject to a United States Government embargo and are not on any United States Government list of prohibited or restricted parties. When using the App, the User also complies with the third-party terms that bind them (e.g. the terms of their mobile network operator and of the Store).
- The App uses system permissions only with the User's consent: notifications (reminders) and opening the system browser for logging in via Google, Apple or Facebook. The App does not offer payments outside the Store and does not request access to location, contacts, photos or the microphone.
- The App currently does not display advertisements. In the future, the Service Provider may display advertisements in the free part of the App. The introduction of advertisements will be announced in the App and described in the Privacy Policy before it takes place, and personalised advertisements will be displayed only with the User's separate consent given in the App. Such a change does not restrict the scope of the Package under § 3(3).
- The age rating of the App in the Store and parental controls are set by the Store and the User; these terms apply § 5(3).
§ 17. Personal data
The rules for processing personal data, including in the App, and the rules for the use of cookies are described in the Privacy Policy and on the Cookies page, available in the Service and in the App.
§ 18. Changes to the terms
- The Service Provider may change these terms for important reasons: a change in the law or in its interpretation, the introduction or change of services, features, sales channels or payment methods, a change in the details of the Service Provider or of operators, Store requirements, improved security or the need to remove ambiguities.
- Users who have an Account are informed of a change, together with its content, by e-mail and on the Platform at least 14 days before the changes take effect. A User who does not accept the changes may, until the day they take effect, terminate the contract for maintaining the Account (delete the Account); in that case the holder of an active Package is entitled to a refund of the price proportional to the unused period.
- Changes do not affect acquired rights: Packages bought before a change are governed by these terms as worded on the date of purchase, unless the new wording is more favourable to the User or the change results from the law.
- Purely editorial changes that do not alter rights and obligations (e.g. correction of obvious errors, a change of the Service Provider's registration or address details that does not change the address for complaints) may take effect without observing the period referred to in paragraph 2, with information on the Platform.
§ 19. Final provisions
- Contracts concluded under these terms are governed by Polish law, in particular the Civil Code, the Act of 30 May 2014 on Consumer Rights and the Act of 18 July 2002 on the Provision of Electronic Services.
