Is it permitted behind the visible prohibition sign to stop a motor vehicle on the pavement?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are driving along a street in a town behind a red tanker; on the right there are signs B-33 "40" and B-36 "no stopping" with plate T-25b, which shows that the ban continues further on. Beyond these signs parking a power-driven vehicle on the pavement is not allowed - the ban on stopping covers the whole side of the road on which the sign stands, and so also the pavement. The answer is: no.

The Regulation on road signs and signals states that sign B-36 means a ban on stopping a vehicle, and that the ban expressed by this sign applies to the side of the road on which the sign is placed, except for places where parking or stopping is allowed by a sign. Since even a brief stop is prohibited, parking - that is, a standstill longer than one minute - is certainly prohibited. The pavement is part of the road, so driving onto it does not get around the ban - this is a common mistake of drivers who think that B-36 applies only to the roadway. You look for a parking place only beyond a sign that cancels the ban, or on the other side of the street if there are no bans there.

Legal basis: § 28 para. 2 and para. 3 point 1 of the Regulation on road signs and signals; Art. 2 point 29 and 30 of the Road Traffic Act (Prawo o ruchu drogowym)
