Question no. 9372 3 pts basic B

In the presented situation, are you allowed beyond the visible sign to stop with the wheels of one side on the pavement?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving along a street in a town along a fence and trees; on the right there is sign B-36 "no stopping", and a car is coming from the opposite direction. Beyond the visible sign you must not stop with the wheels of one side on the pavement. The answer is: no.

The Regulation on road signs and signals states that sign B-36 means a ban on stopping a vehicle, applies to the side of the road on which it stands, and remains in force until it is cancelled or up to the place where sign B-35 is placed - without a plate it takes effect from the place where it stands. The Road Traffic Act allows a passenger car to stop on a footway (droga dla pieszych), that is on the pavement, with the wheels of one side or the front axle only when there is no ban on stopping or parking on that section of the roadway; with B-36 this condition is not met, so the pavement on the side of the sign is covered by the ban just like the roadway. A common mistake drivers make is thinking that if the car is not on the roadway, they are not disobeying the sign - but in fact the ban covers the whole side of the road. The only exception is a standstill forced by traffic conditions or traffic rules, for example stopping for a pedestrian on a crossing.

Legal basis: § 28 para. 2-4 of the Regulation on road signs and signals; Art. 47 para. 1 point 1 of the Road Traffic Act (Prawo o ruchu drogowym)
