Is it allowed in the presented situation to stop the vehicle on the roadway?

Show the correct answer

Correct answer

NO

Explanation

In the photo, you are driving under a flyover (viaduct) on a roadway which, on a curve, has three lanes with lane direction arrows; your lane, the right one, is separated from the next lane by a solid line, and its right edge is marked by a solid edge line. Stopping the vehicle on the roadway is not allowed here. The answer is: no.

The Road Traffic Act prohibits stopping a vehicle on the roadway next to a solid line marking the edge of the roadway, and also along a solid line and near its end points, if this would force other drivers of multi-track vehicles to drive onto this line - your lane is bordered by solid lines on both sides, so every car would have to drive onto them to go around you. In addition, stopping and parking are allowed only in a place where the vehicle is visible to others from a sufficient distance and does not cause danger or obstruct traffic; on a curve under a flyover, where the pillars and the bend of the roadway limit visibility, a stationary car would only be seen from close up, and not far beyond the flyover there is a junction, before which stopping is also prohibited. If your car breaks down, you keep going until you reach a place where you can pull over safely.

Legal basis: Art. 49 para. 1 point 1, 4 and 5 and Art. 46 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 86 para. 8 of the Regulation on road signs and signals
