On the presented road, does the sign prohibiting overtaking cease to apply at the end of the bend?

Show the correct answer

Correct answer

NO

Explanation

In the photo, you are driving along a road through fields and approaching a bend; on the right there are signs A-1 "dangerous right bend" and, below it, B-25 "no overtaking", and there are cars driving in front of you. The sign prohibiting overtaking does not stop applying at the end of the bend. The answer is: no.

The Regulation on road signs and signals states that sign B-25 "no overtaking" prohibits drivers of power-driven vehicles from overtaking multi-track power-driven vehicles, and if the ban is not cancelled earlier by a sign marking the end of the ban, it applies until the nearest junction. The end of the bend is neither a cancellation nor a junction - after you leave the curve, the ban continues until sign B-27 "end of no overtaking", B-42 "end of prohibitions" or until a junction. Drivers often confuse this with the ban in the Road Traffic Act on overtaking on a bend marked with warning signs, which really does end together with the bend; here, however, there is also sign B-25, and it follows its own rules. The ban from B-25 does not cover overtaking two-wheelers, for example motorcycles and bicycles, but when you overtake them, you still need visibility and space.

Legal basis: § 23 para. 1 and § 32 para. 1 and 2 of the Regulation on road signs and signals; Art. 24 para. 7 point 2 of the Road Traffic Act (Prawo o ruchu drogowym)
