In the presented situation, can you stop the vehicle on the shoulder before the sign?
Show the correct answer
Correct answer
NO
Explanation
In the photo you are driving along a street in a town; on the right there is sign B-36 "no stopping" with plate T-25c - an arrow pointing down - and there is an unpaved shoulder along the roadway. You cannot stop the vehicle on the shoulder before the sign, because the ban still applies there. The answer is: no.
The Regulation on road signs and signals states that sign B-36 means a ban on stopping a vehicle and applies to the side of the road on which it stands, and plate T-25c under the sign shows the end of the ban. So a sign with such a plate stands at the end of the no-stopping zone: before it the ban continues, beyond it the ban ends. Stopping just before the post means stopping in a place covered by the ban, just as prohibited as a hundred metres earlier. The shoulder changes nothing, because the ban covers the whole right-hand side of the road - the roadway, the shoulder and the pavement. The only exception is a standstill forced by traffic conditions or traffic rules, for example stopping for a pedestrian who is crossing. If you want to stop, you drive a few metres further on, beyond the sign, where stopping on the shoulder is already allowed, as long as no other rule prohibits it.
Legal basis: § 28 para. 2, para. 3 point 1 and 3 and para. 7 point 3 of the Regulation on road signs and signals
