In this situation, are you permitted to stop the vehicle for a while on the roadway in order to drop off a passenger?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are driving along a street in a town behind a red tanker with warning plates; on the right there is sign B-33 "40", and below it B-36 "no stopping" with plate T-25b, which shows that the ban continues further on. You are not allowed to stop your vehicle here even for a moment to drop off a passenger - that is also stopping. The answer is: no.

The Regulation on road signs and signals states that sign B-36 "no stopping" means a ban on stopping a vehicle, that the ban applies to the side of the road on which the sign is placed, and that the only exception is vehicles at a standstill because of traffic conditions or traffic rules, for example in a traffic jam. The Road Traffic Act defines stopping as a standstill of a vehicle that does not result from traffic conditions or traffic rules and lasts no longer than 1 minute - briefly dropping off a passenger fits this definition. Sign B-36 is put up where even a brief stop blocks traffic or limits visibility, as on this narrow, busy section. You drop off the passenger before the sign or after the end of the ban, in a place where stopping is allowed and does not obstruct traffic.

Legal basis: § 28 para. 2, 3 and para. 7 point 2 of the Regulation on road signs and signals; Art. 2 point 29 of the Road Traffic Act (Prawo o ruchu drogowym)
