If you ride a single-track motorcycle, can you transport a passenger who is intoxicated?

Show the correct answer

Correct answer

A. No.

Explanation

In the photo you can see a motorcycle from behind, and a man is walking away from it; there is a helmet lying on the motorcycle. You are not allowed to carry an intoxicated passenger on a single-track motorcycle - answer A.

The Road Traffic Act forbids carrying a person who is intoxicated, after drinking alcohol or after taking a substance with an effect similar to alcohol on a bicycle, moped or motorcycle, unless the person is carried in a sidecar. Intoxication means more than 0.5 per mille, but the ban already covers the state after drinking alcohol (from 0.2 per mille), so it certainly applies to an intoxicated person. Answers B and C add conditions that are not in the provision - neither a speed limit nor your assessment of coordination changes anything. An intoxicated passenger on a two-wheeler is a danger to you both: they will not keep their balance in a bend, may let go of the handles when braking, and in a fall will pull the motorcycle down. The only legal solution in the photo is to leave your friend and call a taxi for him.

Legal basis: Art. 45 para. 2 point 2 and para. 1 point 1 of the Road Traffic Act (Prawo o ruchu drogowym)
