Can you drive a truck whose weight, including the cargo, is higher than the admissible weight along a given section of the road?

Show the correct answer

Correct answer

B. Yes, but provided that a relevant permit is obtained.

Explanation

In the photo a lorry with a container body is driving through a junction with traffic lights in a town. A vehicle whose mass together with its load is greater than permitted on a given section of road may travel only after obtaining the appropriate permit - the answer is B.

The Road Traffic Act treats a vehicle whose actual total mass, with or without a load, is greater than permitted as an abnormal (oversize or overweight) vehicle, and allows it to travel only after a permit of the appropriate category has been obtained and while observing the conditions stated in it. So you cannot drive there without any conditions (answer A), and the rules do not provide for any special fee paid to the head of the commune (wójt) (answer C) - permits are decided by the authorities named in the Act, for example the starost (head of the district authority) or the General Director for National Roads and Motorways. Mass is especially important on bridges and flyovers, so the category of the permit determines on which roads you may drive, and for the heaviest journeys the permit sets a specific route. For a journey without a permit, the carrier may be given a financial penalty.

Legal basis: Art. 2 point 35a, Art. 64 para. 1 and Art. 140aa para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
