Which of the following actions towards a person injured in an accident may entail penal liability?

Show the correct answer

Correct answer

A. Failure to provide any aid.

Explanation

In the photo you can see the scene of an accident on a town street: two wrecked cars, a police car, a police officer directing traffic and an ambulance. Failing to give any help to an injured person may lead to criminal liability - answer A. An unprofessional (B) or even incorrect (C) rescue action taken in good faith is not punished.

The Criminal Code states that anyone who does not help a person who is in a situation of immediate danger of losing their life or suffering serious harm to their health, although they could help without putting themselves or another person in such danger, is liable to imprisonment for up to 3 years. The Road Traffic Act requires a person involved in an accident to give the necessary help to the victims and to call an ambulance and the police. Nobody expects you to have a doctor's skills - it is enough to call for help, secure the scene and do what you can, following the dispatcher's instructions.

Legal basis: Art. 162 § 1 of the Criminal Code; Art. 44 para. 2 point 1 of the Road Traffic Act (Prawo o ruchu drogowym)
