When riding a motorbike, can you overtake a passenger car beyond this sign?

Show the correct answer

Correct answer

NO

Explanation

In the picture, the round sign with a red border and two cars - a red one on the left and a black one on the right - is B-25 "no overtaking". When riding a motorcycle, you are not allowed to overtake a passenger car beyond this sign. The answer is: no.

The Regulation on road signs and signals states that sign B-25 "no overtaking" prohibits drivers of power-driven vehicles from overtaking power-driven multi-track vehicles. The ban has two sides: it is addressed to every driver of a power-driven vehicle - and a motorcycle is a power-driven vehicle - and what it prohibits is overtaking a power-driven multi-track vehicle, that is - in everyday terms - one that leaves more than one wheel track, for example a passenger car, a lorry or a bus. So a motorcycle rider beyond sign B-25 cannot overtake a passenger car, even though the motorcycle itself is a two-wheeler; however, the rider may overtake another motorcycle without a sidecar, a moped or a bicycle, because these are not multi-track vehicles or are not power-driven at all. The ban applies until the nearest junction or until sign B-27 "end of no overtaking". A common trap: the belief that a narrow vehicle "is not overtaking, just driving past" - the Road Traffic Act does not recognise such a distinction.

Legal basis: § 23 para. 1 and 4 and § 32 para. 2 of the Regulation on road signs and signals; Art. 2 point 28 and 32 of the Road Traffic Act (Prawo o ruchu drogowym)
