In this situation, should you yield the right of way to the pedestrian?

Show the correct answer

Correct answer

YES

Explanation

In the video, you are driving along a street in a small town and approaching a pedestrian crossing marked with sign D-6; from the left, a person on a bicycle rides up to the crossing, stops at the stripes and gets off the bicycle. You should give way to this person. The answer is: yes.

The Road Traffic Act requires a driver approaching a pedestrian crossing to exercise particular caution, to reduce speed so as not to endanger a pedestrian who is on the crossing or stepping onto it, and to give way to a pedestrian who is on the crossing or stepping onto it. A person walking with a bicycle is a pedestrian - the Act expressly counts as a pedestrian a person walking with, pulling or pushing a bicycle, moped, pram or scooter - so on the crossing they have the same right of way as any pedestrian; only if they got on the bicycle and rode it would they become a rider, and they would not have right of way on the pedestrian crossing. Giving way means that you must not force the pedestrian to stop, slow down or speed up. So you slow down already as you approach the crossing, and when you see the person stepping onto the stripes, you stop and wait until they have crossed.

Legal basis: Art. 26 para. 1, Art. 2 point 18 and 23 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
