In this situation, are you entitled to continue driving without paying attention to the behaviour of pedestrians?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are approaching a pedestrian crossing marked with sign D-6 on a road outside town; on the right, right on the kerb next to the zebra crossing, two girls are standing facing the roadway. In this situation you are not entitled to drive on without paying attention to their behaviour. The answer is: no.

The Road Traffic Act states that a driver approaching a pedestrian crossing is obliged to exercise particular caution, reduce speed so as not to endanger a pedestrian who is on the crossing or stepping onto it, and give way to such a pedestrian. The girls have not yet stepped onto the crossing, so formally they do not have right of way, but they are standing right next to the crossing and may take a step at any moment - and then they will become pedestrians stepping onto the crossing, to whom you give way. Particular caution means exactly this: watching them and keeping a speed at which you can stop in time. Driving "without paying attention" would be the opposite of this duty and a breach of the rule that you must not put anyone in danger. You slow down and watch them and the other side of the road; if they start to cross, you stop.

Legal basis: Art. 26 para. 1, Art. 13 para. 1a and Art. 3 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
