Question no. 10250 3 pts basic B

In this situation, are you entitled to exceed the speed limit to complete the overtaking manoeuvre as quickly as possible?

Show the correct answer

Correct answer

NO

Explanation

In the video, you are driving on a road outside town, next to a maize field, and you are on the left side of the roadway, overtaking an agricultural tractor with a trailer. You are not entitled to exceed the speed limit to finish overtaking as quickly as possible. The answer is: no.

The Road Traffic Act sets the speed limit - outside built-up areas on an ordinary road it is 90 km/h - and provides no exception to it for overtaking; the obligation to drive at a speed that does not exceed the limit and ensures control over the vehicle applies to the whole manoeuvre. You may start overtaking only when you have enough room to do it without impeding anyone - if you could fit in the opposite lane only by exceeding the speed limit, it means there is not enough room and you should not start the manoeuvre. A tractor travels at 20-30 km/h, so at 90 km/h you will overtake it in a few seconds and over a few dozen metres without breaking the rules. The popular belief that "when overtaking, you may speed up above the limit" is a myth - neither a speed camera nor a police officer will accept such an excuse, and a higher speed in the opposite lane lengthens your braking distance if a car appears from the opposite direction.

Legal basis: Art. 20 para. 3 point 1 letter d, Art. 19 para. 1 and Art. 24 para. 1 point 1 of the Road Traffic Act (Prawo o ruchu drogowym)
