Are you obliged in this situation to wait for entry to the intersection?

Show the correct answer

Correct answer

YES

Explanation

In the photo you are approaching a wide junction in town, with cars driving across it; the traffic lights on the right show a red signal, sign D-6b hangs above them, and in front of you there is a pedestrian crossing. You must wait to enter the junction. The answer is: yes.

The Regulation on road signs and signals states that a red signal given by traffic lights S-1 means a ban on driving beyond the traffic lights, and stopping the vehicle because of the signal should take place before the stop line, and if there is none - before the traffic lights. The red light is unconditional: it does not matter that the junction seems empty for a moment or that nobody is walking on the crossing - at this time other entries have green and vehicles may come in at high speed. On red you are also not allowed to get around the light by using the next lane or to turn right, unless a green filter arrow S-2 is lit. You stop before the crossing - before the stop line, and if there is none, before the traffic lights - wait for green and move off only after checking that the junction is clear and that nobody is still walking across the zebra crossing.

Legal basis: § 95 para. 1 point 3 and § 99 para. 1 of the Regulation on road signs and signals; Art. 5 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
