In the visible situation, do you have the right to drive onto the level crossing, if there is no rail vehicle approaching?

In the photo you are approaching a level crossing without barriers in a town; on the right there is a double St Andrew's cross G-4 with sign B-20 "STOP", and the tracks cross the roadway just in front of you. You are not allowed to enter the crossing without stopping, even if no rail vehicle is approaching. The answer is: no.

The Regulation on road signs and signals states that sign B-20 "STOP" means no entry without stopping and applies accordingly to a sign placed in front of the tracks of rail vehicles, and cross G-4 marks the place to stop because of train traffic at a multi-track crossing without barriers. The Road Traffic Act additionally requires you to exercise particular caution and to make sure that no rail vehicle is approaching. At a crossing without barriers, stopping is mandatory regardless of what you see - a train can appear from behind a bend or buildings within a few seconds, and the duty to stop does not depend on whether you can see one at that moment. You stop in front of the cross, look and listen in both directions, check both tracks, and only then do you drive across.
