Is driving a vehicle under the influence of alcohol subject to violation?

Show the correct answer

Correct answer

YES

Explanation

The photo shows bottles of wine and whisky and glasses. If you drive a vehicle after drinking alcohol, you are liable for a petty offence. The answer is: yes. If the concentration were higher and meant intoxication, it would already be a crime.

The Road Traffic Act prohibits a person from driving a vehicle after drinking alcohol, and the Code of Petty Offences states that anyone who, after drinking alcohol or taking a substance that acts similarly, drives a mechanical vehicle in land traffic is subject to detention or a fine; a driving ban is also mandatory. The state after drinking alcohol means from 0.2 to 0.5 per mille in the blood (from 0.1 to 0.25 mg per 1 dm3 of exhaled breath), and above these values intoxication begins, for which the Criminal Code provides imprisonment, a driving ban for many years and a compulsory payment (świadczenie pieniężne). The difference between a petty offence and a crime is often just one glass, and in both cases you get a driving ban (for a petty offence from 6 months to 3 years) and penalty points. There is one rule: after alcohol you do not drive, even if you feel sober.

Legal basis: Art. 45 para. 1 point 1 of the Road Traffic Act (Prawo o ruchu drogowym); Art. 87 § 1 and 3 of the Code of Petty Offences; Art. 46 para. 2 of the Act on Upbringing in Sobriety and Counteracting Alcoholism; Art. 178a § 1 of the Criminal Code
