Can you ride a towed motorcycle if you do not hold a motorcycle licence?

Show the correct answer

Correct answer

A. No.

Explanation

In the photo one motorcycle is towing another on a rope; a rider is sitting on the towed one. You do not have the right to ride a towed motorcycle if you do not have a driving licence that entitles you to ride it - answer A.

The Road Traffic Act states that towing a power-driven vehicle is allowed only if there is a driver in the towed vehicle who is entitled to drive that vehicle, unless the vehicle is towed in a way that means it does not need to be steered. A towed motorcycle has to be ridden: you must keep your balance, turn and brake - so a rider sits on it, and it must be a rider with a category A driving licence (or A1, A2, depending on the motorcycle). The type of connection does not matter here (answers B and C): a motorcycle may be towed only on a flexible connection anyway, and this needs steering even more. The exception "without the need to steer" applies to towing with a raised axle on a special device; in practice, a motorcycle is then carried on a recovery truck, and that is no longer towing. A person without the right licence on a towed motorcycle commits the petty offence of driving without entitlement - in the same way as if they were riding under their own power.

Legal basis: Art. 31 para. 1 point 3 and 4 of the Road Traffic Act (Prawo o ruchu drogowym); Art. 3 para. 1 point 1 of the Vehicle Drivers Act (ustawa o kierujących pojazdami)
