Can you drive the proper motor vehicle for a B1-category driving licence if it is expired?

Show the correct answer

Correct answer

C. No.

Explanation

In the photo you can see the back of an old, pink driving licence: in the category B1 row the date of issue of the entitlement, 18.01.98, and its expiry date, 18.01.13, have been entered. With an invalid category B1 driving licence you are not allowed to drive a quadricycle - answer C.

The Vehicle Drivers Act states that the document confirming the entitlement to drive a vehicle is a driving licence, and a category B1 driving licence is issued for a period of 15 years. After the date entered in the document has passed, it no longer confirms your entitlement, so when you drive a vehicle you do not have a valid driving licence. The regulations do not provide for any transition period - neither 7 days (answer A) nor 14 days (answer B). It is best to submit the application for a replacement at the vehicle licensing office (wydział komunikacji) in advance, because you cannot drive until you collect the new driving licence. The same applies to driving licences of other categories: the date in field 11 or 4b is the last day on which the document is valid.

Legal basis: Art. 4 para. 1, Art. 6 para. 1 point 5 and Art. 13 para. 1 point 1 of the Vehicle Drivers Act (ustawa o kierujących pojazdami)
