What must you not do if you're involved in an accident where there are fatalities?

Show the correct answer

Correct answer

A. Remove the car from the road so that it does not cause an obstacle to traffic.

Explanation

In the photo you can see a crash at a junction: a wrecked white lorry and a dark passenger car with a crushed side. When you are involved in an accident in which people have been killed, you are not allowed to move the vehicle off the road, even if it obstructs traffic - answer A. Giving help to the victims (B) and calling the emergency medical services (C), on the other hand, are your duties.

The Road Traffic Act requires you to move the vehicle away from the scene of the accident without delay only when nobody has been killed or injured. If someone has been killed or injured, the driver must give the necessary help to the victims, call the emergency medical services and the police, not take any actions that could make it harder to establish how the accident happened, and stay at the scene. The position of the vehicles, the skid marks and the scattered parts allow experts to reconstruct the event, so moving the car may be treated as removing evidence. You secure the scene with the warning triangle and the hazard warning lights, and you leave the cars where they stopped.

Legal basis: Art. 44 para. 1 point 3 and para. 2 point 1-3 of the Road Traffic Act (Prawo o ruchu drogowym)
