Is the motorcycle left unattended in the parking lot properly protected against being started by unauthorized person?

Show the correct answer

Correct answer

NO

Explanation

In the photo a motorcycle is parked on the pavement next to a street, and its rider is walking away while talking on the phone; the key has been left in the ignition. A motorcycle left like this is not properly protected against being started by an unauthorised person. The answer is: no.

The Road Traffic Act states that the driver of a vehicle is obliged, while parked, to protect the vehicle against being started by an unauthorised person and to take other precautions necessary to avoid an accident. A key left in the ignition is an invitation: any passer-by can turn it, start the engine and ride away, or, not knowing how to ride, knock the motorcycle over onto pedestrians. Protecting it means at least taking out the key and locking the handlebars with the ignition lock, and when parking for longer, also fitting a wheel lock or a brake disc lock. This matters not only as protection against theft - if such a person causes an accident, questions about responsibility may also be directed at the person who left the key. In addition, before walking away you put the motorcycle securely on its stand, so that it does not slide onto the roadway or fall over onto the pavement.
