Should you move the motorcycle which broke down onto the hard shoulder in this situation?

Show the correct answer

Correct answer

YES

Explanation

In the photo, on a two-way roadway, at sign D-43 "end of built-up area", there is a motorcycle with a motorcyclist next to it - the motorcycle has broken down and is blocking the traffic lane. You must move it onto the shoulder. The answer is: yes.

The Road Traffic Act states that stopping and parking a vehicle are allowed only in a place and in conditions in which it is visible from a sufficient distance and does not cause danger or obstruct traffic, and when parked on a road outside a built-up area, the vehicle should be off the roadway, if at all possible. A broken-down motorcycle in the traffic lane is an obstacle for everyone driving behind you, and a single motorcycle can easily be pushed onto the shoulder - so the condition "if at all possible" is met. Only when the vehicle stands safely off the roadway do you deal with the repair or call for help. If the motorcycle cannot be moved and must stay on the roadway, you mark the damaged vehicle: outside a built-up area with a warning triangle placed 30-50 m behind the vehicle and with hazard warning lights.

Legal basis: Art. 46 para. 1 and 3 and Art. 50 para. 1 point 2 letter a and para. 2 point 2 letter a of the Road Traffic Act (Prawo o ruchu drogowym)
