Is the tractor left unattended in the parking lot properly protected against being started by unauthorized person?

Show the correct answer

Correct answer

NO

Explanation

In the photo you can see the dashboard of a red tractor; a key with a white key ring is in the ignition. A tractor left like this is not protected against being started by an unauthorised person - the answer is NO.

The Road Traffic Act requires the driver, while parked, to protect the vehicle against being started by an unauthorised person and to take other precautions needed to avoid an accident. A key in the ignition is an invitation to anyone - all they need to do is turn it. A tractor is often parked in a yard, by a field or by a road, where curious children or a thief can easily come along, and if someone inexperienced starts it, it may move off with a gear engaged or lower a raised implement and crush someone. Before you walk away, you take out the key, apply the parking brake, lower the implements to the ground and lock the cab, if possible. On a slope you also leave it in gear or put chocks under the wheels.

Legal basis: Art. 46 para. 5 of the Road Traffic Act (Prawo o ruchu drogowym)
