Are you obliged in this situation, when parking the motorcycle on the roadway, to switch on the position lights or parking lights?

Show the correct answer

Correct answer

YES

Explanation

In the photo, at night, on an unlit road outside a town, a parked motorcycle with its lights on is standing at the right edge of the roadway. When you park a motorcycle on the roadway in such a place, you must switch on the sidelights (position lights) or parking lights. The answer is: yes.

The Road Traffic Act states that the driver of a power-driven vehicle, in conditions of insufficient visibility, during stopping not caused by traffic conditions and during parking, must use the front and rear sidelights or the parking lights; all lights may be switched off only when parking in a place lit well enough to make the vehicle visible, or off the roadway and the shoulder. At night on an unlit road none of these exceptions applies: the motorcycle is on the roadway, in the dark, and an approaching driver would see it without lights only within the range of their own headlights, which is too late. The sidelights or parking lights show from a distance that something is standing at the edge. On many motorcycles the sidelights are switched on with the key in the "P" position or with a separate switch; a flat battery is better than a motorcycle that has been hit. However, it is best not to park on the roadway at night at all, but off it.
