In the presented situation, despite exercising utmost caution, are you restricted from overtaking the vehicle in front of you?

Show the correct answer

Correct answer

YES

Explanation

In the photo you are driving in town in the left-hand lane of a one-way roadway; just ahead of you, in the right-hand lane, a blue car is approaching a pedestrian crossing marked with D-6 signs on a yellow background; a person pushing a bicycle is walking up to the zebra crossing from the left. Even though you exercise particular caution, the ban on overtaking the vehicle in front applies to you. The answer is: yes.

The Road Traffic Act prohibits a driver from overtaking a vehicle on a pedestrian crossing and immediately before it, except at a crossing where traffic is controlled by signals or a police officer, and also from going around a vehicle which was travelling in the same direction but has stopped to give way to a pedestrian. The blue car is immediately before a crossing without traffic lights, so overtaking it now is prohibited no matter how carefully you would do it - "particular caution" allows you to carry out permitted manoeuvres, it does not lift bans. The person pushing a bicycle is a pedestrian and will step onto the zebra crossing in a moment; if the blue car stops to let them cross, you must not go around it. Although you are driving in the next lane, passing it is still overtaking. You slow down together with it, stop before the crossing and move off when the pedestrian has crossed.

Legal basis: Art. 26 para. 3 point 1 and 2 and Art. 2 point 18 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
