In the presented scenario, is it permissible to overtake the vehicle in front of you, provided that due caution is exercised?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are driving in town in the left-hand lane of a one-way roadway; just ahead of you, in the right-hand lane, a blue car is approaching a pedestrian crossing with D-6 signs on a yellow background; a person pushing a bicycle is walking up to the zebra crossing from the left. Even if you exercise particular caution, you must not overtake the car in front. The answer is: no.

The Road Traffic Act prohibits a driver from overtaking a vehicle on a pedestrian crossing and immediately before it, except at a crossing where traffic is controlled by signals or a police officer. The crossing in the photo has no traffic lights, and the blue car is just before it, so any overtaking started now would take place in the area covered by the ban. The ban is absolute: caution does not change the fact that the car being overtaken would hide the pedestrian from you, and you from the pedestrian. In fact, the photo shows why this rule exists - a person pushing a bicycle, that is, a pedestrian, is walking up to the zebra crossing from the left, and the driver in front of you will probably stop in a moment; if you were next to that car in the left-hand lane at that moment, you would drive straight into the person crossing. You slow down together with the car, stop before the crossing and let the pedestrian cross, just as that driver does.

Legal basis: Art. 26 para. 3 point 1 and para. 1 and Art. 2 point 18 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
