Is it prohibited to stop a vehicle on a flyover to drop off a passenger?

Show the correct answer

Correct answer

YES

Explanation

In the photo, in winter, you are driving onto a flyover (viaduct) with blue and white railings on both sides; beyond it, chevron boards show a bend. Stopping a vehicle on the flyover, even just to drop off a passenger, is prohibited. The answer is: yes.

The Road Traffic Act prohibits stopping a vehicle in a tunnel, on a bridge or on a flyover. The ban applies to stopping, so also to a short standstill "for a moment", not longer than a minute - dropping off a passenger is exactly such a situation, so it is not allowed. The reason is simple: on a flyover the roadway is narrow, limited by barriers, without a shoulder, and a stationary car blocks the lane and there is no way to go around it safely; a pedestrian getting out next to the railing has nowhere to go. The ban does not apply to a standstill caused by traffic conditions or traffic rules, for example stopping in a traffic jam; when a car breaks down on a flyover, it must be removed as soon as possible, and until then you must signal that it is parked. You drop off a passenger before driving onto the flyover or beyond it, in a place where stopping is allowed.

Legal basis: Art. 49 para. 1 point 3 and para. 4 and Art. 2 point 29 of the Road Traffic Act (Prawo o ruchu drogowym)
