Are you allowed to overtake the cyclist in this situation?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving on a narrow, winding road among trees, without marked lanes; ahead of you is a cyclist on a recumbent bicycle with a red flag, and beyond him the road bends to the left and visibility ends at the bushes. In this situation you are not allowed to overtake him. The answer is: no.

The Road Traffic Act states that before overtaking, a driver must make sure in particular that he has adequate visibility and enough space to overtake without obstructing anyone, and when overtaking a bicycle, he must keep a distance of not less than 1 m. On such a narrow roadway, keeping a metre of distance means driving onto the left half of the road, and beyond the bend you cannot see whether a vehicle is coming from the opposite direction - so the first condition cannot be met. A three-wheeled recumbent bicycle is also low and wide, and its rider rides close to the middle of the roadway, which further increases the space needed. You stay behind him at a safe distance, do not use the horn and wait until the road straightens and reveals a stretch long enough to overtake with a margin and return to your side.

Legal basis: Art. 24 para. 1 point 1 and para. 2 of the Road Traffic Act (Prawo o ruchu drogowym)
