You are driving a vehicle in a built-up area. Are you allowed to overtake the directly preceding vehicle from the right in this situation?

Show the correct answer

Correct answer

YES

Explanation

In the photo you are driving in a town on a two-way roadway, in a lane with tram tracks; in front of you a car is driving in the same lane, and on your right there is a clear lane going in the same direction, separated by a broken line. In a built-up area you can overtake it on the right. The answer is: yes.

The Road Traffic Act allows overtaking on the right on a section of road with marked lanes on a two-way roadway, if in a built-up area at least two lanes are intended for traffic in the same direction. The condition is that you follow the general rules: visibility, space and no manoeuvre signalled by the vehicle in front of you. You change lanes with your indicator on and do not cut in when you return.

Legal basis: Art. 24 para. 10 point 2 and para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
