Can you perform an overtaking manoeuvre in this situation?
Show the correct answer
Correct answer
NO
Explanation
In the video you are driving in town in the right-hand lane of a roadway with two lanes in your direction; ahead of you, in the left-hand lane, a white car is braking before a pedestrian crossing marked with sign D-6, and from the right a person with a pushchair is approaching the crossing. In this situation you cannot overtake. The answer is: no.
The Road Traffic Act prohibits a driver from overtaking a vehicle on a pedestrian crossing and immediately before it, except at a crossing where traffic is controlled, and also from passing (going around) a vehicle that was travelling in the same direction but has stopped to give way to a pedestrian. The white car is slowing down just before the crossing, and the person with the pushchair will step onto it in a moment - if you drove past the car, you would enter the crossing exactly when the person with the pushchair steps onto it from your side, and that person expects that since one car is braking, the other will stop too. Even if there were no pedestrian, overtaking immediately before a crossing without traffic lights is prohibited in itself. You slow down together with the vehicle in the next lane, stop before the crossing and only move off when the pedestrian has crossed.
Legal basis: Art. 26 para. 3 point 1 and 2 and para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
