In the presented situation, are you obliged to yield the right of way to the vehicle in the roundabout?

Show the correct answer

Correct answer

YES

Explanation

In the photo you are approaching a roundabout; before it on the right there are signs A-7 "give way" and C-12 "roundabout" and a pedestrian crossing, and a lorry with a semi-trailer is driving around the roundabout from the left. You are obliged to give way to vehicles that are on the roundabout. The answer is: yes.

The Regulation on road signs and signals states that sign C-12 means that at the junction traffic moves around an island in the direction shown on the sign, and sign C-12 together with sign A-7 means that a driver who is already within the junction has right of way over a driver entering the junction. At such a roundabout the right-hand rule does not apply - what decides is who is already on the roundabout. So the lorry driving around the roundabout has right of way, and you wait before the entry, stopping before the give-way line (linia warunkowego zatrzymania) if necessary. Giving way means that you must not force the lorry driver to brake or change their path; a long vehicle combination cuts the curve, so you do not squeeze in front of it. You enter when a gap appears in the traffic on the roundabout that lets you join without making anyone's journey difficult.

Legal basis: § 36 para. 1 and 2 and § 5 para. 5 of the Regulation on road signs and signals; Art. 2 point 23 of the Road Traffic Act (Prawo o ruchu drogowym)
