Question no. 9352 3 pts basic B

Is it prohibited to overtake cyclists at all intersections?

Show the correct answer

Correct answer

NO

Explanation

In the video you are driving along a street in a town next to a park and approaching a junction with sign A-7 "give way"; ahead of you, in your lane, there is a cyclist. Overtaking a cyclist is not always prohibited at every junction. The answer is: no.

The Road Traffic Act prohibits overtaking a power-driven vehicle travelling on the roadway at a junction, except at a roundabout or at a junction where traffic is controlled. A bicycle is not a power-driven vehicle, so this ban does not cover it - overtaking a cyclist at a junction is, as a rule, allowed. This does not mean you may do whatever you like: when overtaking a bicycle you must keep a gap of not less than 1 m, you must not overtake on a pedestrian crossing or a cycle crossing or immediately before them, and before the manoeuvre you must have enough space and visibility. At this junction, where you yourself must give way and may have to stop, overtaking the cyclist would be unwise - braking before the priority road, you could cut in front of them. Common sense tells you to wait behind them until you have passed the junction and to overtake them later, on a straight section.

Legal basis: Art. 24 para. 7 point 3 and para. 2, Art. 26 para. 3 point 1 and Art. 27 para. 4 of the Road Traffic Act (Prawo o ruchu drogowym)
