Are you permitted to enter the level crossing while the barrier is being lifted by the railway worker?

Show the correct answer

Correct answer

NO

Explanation

In the photo, at night, you are approaching a level crossing behind a dark pickup; on the right there are signs A-9 "level crossing with barriers" and B-20 "STOP", and the barrier above the roadway is only partly raised - it is rising right now. You are not allowed to enter the crossing until the raising of the barriers has been completed, even when a railway worker is raising them by hand. The answer is: no.

The Road Traffic Act prohibits the driver from driving around lowered barriers or half-barriers and from entering the crossing if their lowering has started or their raising has not been completed; it also requires you to exercise particular caution when approaching the crossing and to make sure that no rail vehicle is approaching. The Regulation on road signs and signals states that sign B-20 in front of the tracks means no entry without stopping. A rising barrier is not yet a "road clear" signal: the crossing keeper may stop it halfway because another train is coming from the other side, and at night an arm at windscreen height is hard to see. You wait behind the pickup in front of the STOP sign until the barrier is vertical, and only after looking both ways along the tracks do you move off.

Legal basis: Art. 28 para. 1 and para. 3 point 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 21 para. 1 and 4 and § 6 para. 1 of the Regulation on road signs and signals
