When riding a moped on the road behind this sign, are you obliged to use a crash helmet?
Show the correct answer
Correct answer
C. Yes.
Explanation
In the drawing there is sign D-52 "traffic zone" with a car symbol. When riding a moped on a road beyond this sign, you are obliged to wear a crash helmet - answer C.
A traffic zone (strefa ruchu) is an area that includes at least one internal road, where the entrances and exits are marked with signs - for example a car park at a shopping centre or the area of a housing estate. Although it is not a public road, the Road Traffic Act sets the traffic rules also in traffic zones, so all the rules apply there, including the obligation for a moped rider and their passenger to wear a crash helmet. Answer A is therefore wrong. The type of road surface (answer B) also does not release you from this obligation - a helmet protects your head in every fall. In car parks and housing estates people often drive slowly, but a car reversing out or a child running out can easily appear there.
Legal basis: Art. 1 para. 1 point 1, Art. 2 point 16a and Art. 40 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 60c of the Regulation on road signs and signals
