You intend to turn right. Do you have the right of way over vehicles travelling along the transverse road?

Show the correct answer

Correct answer

NO

Explanation

In the video you are leaving a small street on a housing estate, at the end of which there are signs D-41 "end of residential area" and B-21 "no left turn", and you intend to turn right into the intersecting road; on the left side of the street a woman is walking towards you. When leaving a residential area, you are joining traffic (włączanie się do ruchu), so you do not have right of way over vehicles travelling along the intersecting road. The answer is: no.

The Road Traffic Act states that joining traffic takes place, among other situations, when you enter a road from a residential area, and a driver joining traffic must exercise particular caution and give way to another vehicle or road user. It does not matter that you are turning right and not crossing the other lane - you give way to vehicles from both sides, and also to pedestrians walking along the pavement you drive across. The Regulation on road signs and signals states that sign D-41 marks the exit from a residential area, and B-21 prohibits turning left and making a U-turn.

Legal basis: Art. 17 para. 1 point 1 and para. 2 of the Road Traffic Act (Prawo o ruchu drogowym); § 58 para. 1 and § 22 para. 1 of the Regulation on road signs and signals
