Are you obliged at the nearest intersection behind this sign to give the right of way to a vehicle approaching from the right?

Show the correct answer

Correct answer

YES

Explanation

In the photo you can see a road before a junction, with sign A-5 "crossroads"; a car is driving through the junction. At the nearest junction beyond the sign, you are obliged to give way to a vehicle approaching from the right - the answer is YES.

Sign A-5 warns of a junction of roads where right of way is not determined by signs. So the right-hand rule applies: a driver approaching the junction gives way to a vehicle approaching from the right, and when turning left - also to a vehicle coming from the opposite direction going straight on or turning right. Before such a junction you slow down, look first to the right and then to the left, and are ready to stop. This rule does not apply to a tram, which has right of way at such a junction regardless of the direction it is coming from.

Legal basis: § 5 para. 1 of the Regulation on road signs and signals; Art. 25 para. 1 and 2 of the Road Traffic Act (Prawo o ruchu drogowym)
