When driving a motor vehicle with a gross weight of 2.5 t, in a built-up area as marked on the road, can you drive at a speed of 70 km/h?

Show the correct answer

Correct answer

A. Yes.

Explanation

In the photo, sign B-33 "70" stands by a two-lane street in a city, next to a bus stop. When driving a motor vehicle with a maximum permissible mass of 2.5 t, you may drive at 70 km/h on a road marked like this, even though it is a built-up area - answer A. Answer B is wrong, and the restriction for the hours 5-23 (C) concerned the former 50 km/h limit and has no connection with the sign.

The Regulation on road signs and signals provides that sign B-33 setting a speed limit higher than 50 km/h, placed in a built-up area, applies to a passenger car, a motorcycle and a lorry with a maximum permissible mass not exceeding 3.5 t, with exceptions concerning, among others, vehicles carrying dangerous goods or towing. A vehicle with a mass of 2.5 t falls within this group. The Road Traffic Act sets 50 km/h in a built-up area, but a sign may raise this limit; it applies up to the nearest junction, the next B-33 or B-34 sign, or the sign marking the end of the built-up area.

Legal basis: § 27 para. 1 and 3 and § 32 para. 2 of the Regulation on road signs and signals; Art. 20 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
