Which of the following vehicles must you not overtake if you ride a motorcycle on the road, once you go past this sign?

Show the correct answer

Correct answer

C. A passenger car.

Explanation

In the photo you are riding on a two-way roadway with a double solid line; a white car is coming from the opposite direction, and on the right there is sign B-25 "no overtaking". On the road beyond this sign, when riding a motorcycle, you must not overtake a passenger car - answer C.

The Regulation on road signs and signals states that sign B-25 prohibits drivers of power-driven vehicles from overtaking multi-track power-driven vehicles. The key word is "multi-track": the ban applies to overtaking cars, tractors and motorcycles with a sidecar - vehicles that leave more than one track. A single-track motorcycle and a moped are single-track vehicles, so B-25 does not prohibit overtaking them (a moped is not even a power-driven vehicle within the meaning of the Road Traffic Act). A passenger car has four wheels and is a multi-track power-driven vehicle, so overtaking it beyond the sign is prohibited. In the photo the ban is also reinforced by the double solid line, which you must not cross. The ban applies until sign B-27 "end of no overtaking", until the nearest junction or until sign B-42.

Legal basis: § 23 para. 1 and § 32 para. 2 of the Regulation on road signs and signals; Art. 2 point 32 of the Road Traffic Act (Prawo o ruchu drogowym)
