What's the maximum speed at which you can ride a motorcycle once you go past this sign, if you carry a five-year-old child?

Show the correct answer

Correct answer

A. 20 km/h.

Explanation

In the photo you are entering a narrow street in a housing estate; on the right there is sign D-40 "residential area" (a blue board with white symbols of a pedestrian, a car, a house and a child playing with a ball). When riding beyond this sign and carrying a five-year-old child, you may ride at no more than 20 km/h - answer A.

The Road Traffic Act states that the speed limit in a residential area is 20 km/h, and the 40 km/h limit for a motorcycle carrying a child up to 7 years old applies subject to exactly this rule about the residential area. When two limits overlap, the lower one applies - here 20 km/h. In a residential area a pedestrian may use the whole width of the road and has right of way over vehicles, children play in the street, and speed bumps do not have to be marked, which is why the speed has been limited to the pace of a fast walk. With a five-year-old on the passenger seat you have one more reason for caution: the child holds on poorly at every jolt. The answers 30 and 40 km/h exceed the limit of the residential area.

Legal basis: Art. 20 para. 2 and para. 6 point 3 and Art. 11 para. 5 of the Road Traffic Act (Prawo o ruchu drogowym); § 58 para. 1 and 2 of the Regulation on road signs and signals
