When riding a motorcycle you participate in a road accident in with a person got injured. Do you need to abide by the prohibition to remove the vehicle from the scene of the accident?

In the photo a motorcycle is lying on its side on a country road, and a warning triangle has been placed on the roadway in front of it - this is the scene of an accident in which someone is injured. When you are riding a motorcycle and are involved in such an accident, you are prohibited from removing the vehicle from the scene. The answer is: yes.

The Road Traffic Act states that a driver involved in a road accident must stop the vehicle, make the scene of the accident safe for traffic and immediately remove the vehicle from the scene so that it does not cause danger or block traffic - but only if no one has been killed or injured. When someone is injured, the duties are different: you must give the necessary help to the victims, call the emergency medical service and the police, not do anything that could make it harder to establish how the accident happened, and stay at the scene. Moving the motorcycle is exactly such an action - it destroys the evidence that the police and experts need to establish who was at fault. So the vehicle stays where it stopped, and you protect traffic in other ways: with a warning triangle, hazard warning lights and a high-visibility vest. Until the police arrive, you are also not allowed to drink alcohol.
