If you're involved in a car accident in which there are injured parties, can you remove your car from the scene of the accident so that it does not create an obstacle to traffic?
Show the correct answer
Correct answer
NO
Explanation
In the photo, you can see the results of a serious accident: a crashed white car with a dented rear is standing on the roadway, in front of it firefighters are working on a second, destroyed car, and onlookers are standing on the pavement. When people have been injured in an accident, you must not remove the vehicle from the scene, even if it is blocking traffic - its position is evidence needed to establish how the accident happened. The answer is: no.
The Road Traffic Act requires you to remove the vehicle from the scene of the accident immediately only when no one has been killed or injured. If someone has been injured, the driver must, in addition, not take any actions that could make it difficult to establish how the accident happened, and moving the car is exactly such an action. In this situation, you leave the car where it stopped, switch on the hazard warning lights, set up the warning triangle and take care of the injured, and the Police decide whether the vehicle may be moved.
Legal basis: Art. 44 para. 1 point 3 and para. 2 point 2 of the Road Traffic Act (Prawo o ruchu drogowym)
