Can you use the horn if the presented vehicle starts to change the lane while you are overtaking?
Show the correct answer
Correct answer
YES
Explanation
It is night, and you are overtaking a works vehicle. If during the manoeuvre it started to move into your lane, this would be a situation of immediate danger: its driver may not have seen you in his mirror. A short use of the horn is then allowed, because you are warning of a real danger, not "chasing" someone off the road.
The Road Traffic Act allows you to use the horn or a light signal when it is necessary to warn of danger. However, it prohibits the misuse of signals and the use of the horn in a built-up area - except when it is necessary because of immediate danger. A vehicle moving into your lane while you are overtaking is exactly such an exception. As well as using the horn, you brake and abandon the manoeuvre if necessary.
Legal basis: Art. 29 para. 1 and para. 2 point 1 and 2 of the Road Traffic Act (Prawo o ruchu drogowym)
