Can you overtake the cyclist in this situation?

Show the correct answer

Correct answer

NO

Explanation

In the video we are riding a moped along a residential street marked with sign A-17 "children", where before the crossing the lanes are separated by a double solid line; in front of us there is a cyclist in a helmet and a high-visibility vest, and further on you can see a pedestrian crossing. In this situation you cannot overtake the cyclist - the answer is NO.

You overtake on the left, and when overtaking a bicycle you must keep a lateral clearance of at least 1 m. In this lane you cannot do this without driving onto the double solid line, and the rules prohibit crossing it or driving onto it. In addition, there is a pedestrian crossing ahead of us, and you must not overtake a vehicle on a pedestrian crossing or immediately before it. So you ride behind the cyclist at a safe distance, do not hurry them with the horn, and overtake only where the signs, road markings and space allow it.

Legal basis: Art. 24 para. 2 and 3 and Art. 26 para. 3 point 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 86 para. 5 of the Regulation on road signs and signals
