Does a traffic light at a pedestrian crossing absolve you of your responsibility to exercise extra caution?

Show the correct answer

Correct answer

NO

Explanation

In the photo you are approaching a junction in town with traffic lights and a pedestrian crossing with plate T-27; the traffic lights show a green arrow and a green light. Traffic lights at a pedestrian crossing do not release you from the duty to exercise particular caution. The answer is: no.

The Road Traffic Act states that a driver approaching a pedestrian crossing is obliged to exercise particular caution, reduce speed so as not to endanger a pedestrian who is on the crossing or stepping onto it, and give way to such a pedestrian. The duty of particular caution has no exception for crossings with traffic lights. A green light gives you the right to enter and right of way, but it does not guarantee that the crossing is empty: a pedestrian may have stepped onto it at the end of their green and is still finishing crossing, someone may run across on red, and a child - plate T-27 warns that the crossing is used particularly often by children - does not always look at the traffic lights. The traffic lights only change who is allowed to go, not the fact that you have to look. When turning on a green arrow, you also give way to pedestrians on the crossing you are driving over.

Legal basis: Art. 26 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 4 and 5 of the Regulation on road signs and signals
