Question no. 13171 3 pts basic B

Are you obliged to give way to a pedestrian entering a crossing?

Show the correct answer

Correct answer

YES

Explanation

In the video you are approaching a pedestrian crossing with a traffic island marked with sign C-9 and bollards; from the right, a man in a white T-shirt is stepping onto the crossing. You have to give way to him. The answer is: yes.

The Road Traffic Act states that a driver approaching a pedestrian crossing must exercise particular caution, reduce speed so as not to endanger a pedestrian who is on the crossing or entering it, and give way to a pedestrian who is on the crossing or entering it. On the other hand, a pedestrian entering the crossing has right of way over a vehicle. The man in the video is just putting his foot on the crossing, so he is a pedestrian entering it - from this moment it is you who must adapt: you slow down and stop before the crossing, and move off when he has crossed your lane. You do not assume that he "will manage to cross" before you get there; at a traffic island, you also look at the other side, where someone else may step on.

Legal basis: Art. 26 para. 1 and Art. 13 para. 1a of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
