Are you obliged in this situation to stop the vehicle?

Show the correct answer

Correct answer

YES

Explanation

In the video you are approaching a pedestrian crossing in a town, marked with sign D-6 and with a traffic island; a person in a wheelchair is crossing from the left, across your lane, and is finishing crossing at the right-hand kerb. You are required to stop the vehicle. The answer is: yes.

The Road Traffic Act states that when a person with a disability using a special sign, or a person with visibly reduced mobility, is crossing the roadway, the driver must stop the vehicle to allow them to cross; regardless of this, when approaching a crossing, the driver must reduce speed and give way to a pedestrian on it or entering it. With a pedestrian it is usually enough to "give way" - sometimes just to slow down; with a person in a wheelchair the Act directly requires you to stop, because crossing the roadway takes them more time, and their ability to react suddenly is smaller. So you stop before the crossing, give the person in the wheelchair time to reach the kerb, and only move off when they have gone onto the pavement on the right. You do not use the horn and do not move forward "to encourage them" - hurrying someone is a misuse of the horn and stresses a person who cannot go faster.

Legal basis: Art. 26 para. 1 and 7 of the Road Traffic Act (Prawo o ruchu drogowym); § 47 para. 1 and 4 of the Regulation on road signs and signals
