In this situation, do you have the right of way over the cyclist?

Show the correct answer

Correct answer

NO

Explanation

In the video we are riding a moped along a street in town towards a pedestrian crossing with a cycle crossing, marked with D-6b signs; a cyclist is just riding over the cycle crossing. In this situation you do not have right of way over the cyclist - the answer is NO.

The Road Traffic Act requires a driver approaching a cycle crossing to exercise particular caution and to give way to a cyclist who is on the crossing. The cyclist is already on the crossing, so you must slow down and, if necessary, stop so that they can cross safely. A cycle crossing is marked on the roadway with squares (marking P-11), often also on a red surface. Cyclists move faster than pedestrians, so you look at the cycle crossing early enough - from a distance, not only right at the edge.

Legal basis: Art. 27 para. 1 of the Road Traffic Act (Prawo o ruchu drogowym)
