Is the driver in the right lane obliged to allow the vehicle in front of you to change lanes at this point?

Show the correct answer

Correct answer

NO

Explanation

In the photo there is a dual carriageway in a traffic jam; you are driving in the left lane behind a white car, in the right lane there are a red car and a white minibus, which are not moving, and on the left, already next to you, there is an area closed to traffic, but the left lane still continues further alongside it. The driver in the right lane is not required to allow the vehicle in front of you to change lanes at this point already. The answer is: no.

The Road Traffic Act states that when there is a significant reduction in speed, the driver in the neighbouring lane must allow one vehicle from the ending lane to change lanes directly before the point where that lane ends. The obligation does not arise at just any point before the narrowing, only just before it - where the lane really ends. The white car in front of you still has some of the lane ahead of it, so it should drive to its end, and only then is the driver in the right lane required to let it in. The zipper merge requires drivers in the ending lane to drive to the end, and drivers in the neighbouring lane to let in one vehicle at a time at the point where the lane ends.

Legal basis: Art. 22 para. 4a of the Road Traffic Act (Prawo o ruchu drogowym)
